			<content:encoded><![CDATA[<p>After <a href="http://barelylegalsubstance.chattablogs.com/archives/027444.html">posting about why wikis suck for law firms</a>, I&#8217;m finding my concerns both ignored, addressed, and transcended. But one use of wikis that I did not consider was to do <a href="http://www.illinoistrialpractice.com/2005/12/wikis_as_a_libr.html">cross-firm collaboration on legal matters</a>. Thanks to Evan Schaeffer for promoting this to my attention.</p>
<p>I have also had a little more experience with wikis since my original post, and would like to modify my thoughts regarding their use. Mainly, <i>wikis work best when they create a resource for a group, rather than replace, supplant, or build off of existing resources</i>. </p>
<p>That&#8217;s my experience with smaller (”We don&#8217;t do wikis because we have no control over them.”</a> Control may be distracting, but its not a worthwhile objection. All but the most Enron of places want to leverage the skillsets of their employees. Sorry, that&#8217;s my attempt at corporatese. Anyway, once you frame social software in terms of knowledge management and project collaboration, the red herring of control dries up.</p>

			<content:encoded><![CDATA[<p>I have been surprised over the last couples of months to find out that there are IT departments and consultants that don’t really understand how their law firm does business. In some of these places the standing excuse uses the size of the firm (&gt; 200 attorneys, etc). Whatever; that&#8217;s not how we roll here.</p>
<p>That&#8217;s a bit of a crow for me, but to be transparent my naïveté is due to the unquestioned commitment of my coworkers and managers to accurately capturing, understand, and wisely implementing business processes and requirements for IT initiatives. In my experience, the software we write is only as successful as the business process it embodies. When we are off the mark or the process is broken, our software is a mangled zombie corpse. When the process is good and our software captures that, it sings a sweet aria.</p>

<p>    I was shocked to find, upon attempting to access your online Express Tag Renewal Center (<a href="http://www.countyclerkanytime.com/onlinesvcs.htm">http://www.countyclerkanytime.com/onlinesvcs.htm</a>), that you do not support standards-based web browsers (<a href="https://secure.hamiltontn.gov/cclerk/tags/browser.asp">https://secure.hamiltontn.gov/cclerk/tags/browser.asp</a>) like Firefox (<a href="http://www.getfirefox.com">http://www.getfirefox.com</a>). I and many of my friends and family (all your constituents) only use web browsers that adhere to the formal standards of the web (<a href="http://webstandards.org/about/">http://webstandards.org/about/</a>) and that offer full protection from various internet exploits and dangers (<a href="http://www.mozilla.org/support/firefox/faq.html#mozvsie">http://www.mozilla.org/support/firefox/faq.html#mozvsie</a>). To not offer your services to us because of our choice is both a slight and a self-condemnation.</p>
<p>    Upon examination of your county web site, it seems that it currently stands in violation of Section 508 (<a href="http://www.section508.gov/index.cfm?FuseAction=Content&amp;ID=3">http://www.section508.gov/index.cfm?FuseAction=Content&amp;ID=3</a>), which mandates compliance with both web standards and disabled accessibility standards (<a href="http://webstandards.org/learn/faq/#p312">http://webstandards.org/learn/faq/#p312</a>). Though Section 508 is a Federal law, and thus does not directly apply to the County, as a government agency compliance with Section 508 demonstrates your concern for standards and accessibility, especially for your constituents who are disabled (<a href="http://www.usdoj.gov/crt/ada/websites2.htm">http://www.usdoj.gov/crt/ada/websites2.htm</a>), also (<a href="http://www.alistapart.com/stories/politics/">http://www.alistapart.com/stories/politics/</a>). Further, demanding the use of closed-source web browsers ignores the quantifiable superiority of other options (<a href="http://www.dwheeler.com/oss_fs_why.html">http://www.dwheeler.com/oss_fs_why.html</a>).</p>
<p>    There are a number of Chattanooga-based small businesses who are competent in the area of standards-based and accessibility-compliant web design (<a href="http://www.aiga50.org/cha/">http://www.aiga50.org/cha/</a>). I suggest that if your IT team does not agree with the industry standards and best practices in this area you avail yourself of their reasonably-priced services. </p>

A city employee who wishes to remain anonymous recently wrote this on a Linux-related mailing list:</p>
<blockquote><p>this sucks&#8230; the reason they wanted to know what sort of user-agent info is being sent from Safari is so that they could *allow* that browser to access the County Clerk tag &amp; title website&#8230; [I] asked why the hell can&#8217;t I use Firefox anymore?   Their reason:<br />
Firefox is open source.  A hacker could modifiy the code and post a hacked version of Firefox on the net.  People download the hacked version of Firefox and it sends passwords and other sensitive information back to the hacker.<br />
&#8230;the guy who made the policy to block Firefox [on the Express Tag Renewal Center] is one of the programming team managers here.   the programmer said he wanted to block firefox, not because of security issues, but because he didn&#8217;t want to code his website to work with all possible browsers.</p></blockquote>
<p>In light of what the city employee posted, my letter attempts to take the County&#8217;s elected officials to task. If you care about this sort of stuff, take a couple minutes and write to the addresses I noted above with your concerns.</p>
<p>This, while other counties are <a href="http://www.oit.state.pa.us/oaoit/cwp/view.asp?Q=205299&amp;A=722">cutting costs and increasing performance by switching to free/open source software</a>.</p>

			<content:encoded><![CDATA[<p>It occurs to me that I am working with perhaps the last generation of lawyers (and any other white-collar, services-based type of person) who are technologically disabled. When these guys (yes, males, as a rule, except for the few members of the pioneering generation of women in law) die off, there will be no one else to ask what &#8216;copy and paste&#8217; means, or not be able to accomplish the same abstract task using different programs. I won&#8217;t have to show another Of Counsel where the Reply button is located in Microsoft Outlook, having changed locations and icons from Lotus Notes. There will be no more web-based evaluations printed out, hand-filled, and sent across cities and time zones to the evaluation supervisor to input into the &#8216;Internet&#8217;. </p>
<p>Heck, the amount of paper consumed by law firms everywhere will drop by 75%, at least. In my mind, there&#8217;s the diminished, hoary, antediluvian lawyer who says to his young paralegal, &#8220;Do you know anything about this &#8216;Internet&#8217;, son? I heard Old Crotchitkins mention it to Knoobly-Knees at the [Ye Olde Closed-Membership] Clubb yester-evenin&#8217;. Said you could find out just about anything on it regarding my favorite pass-time of dominos. Also said that his son even found out the Anneballon&#8217;s secret mint julep recipe. I&#8217;ve been trying to get that out of that son-of-a-gun for years.&#8221; The bow-tied-one coughs. &#8220;Could you go and print out that &#8216;Internet&#8217; for me so I can read up on it?&#8221; </p>
<p>But that just might be the last time that request is ever made. Strange to think that we might have to shift from dealing with an extreme lack of savvy to an extreme over-use of savvy, like those enterprising Stanford applicants who are now calling up their 2nd-tier schools. Just something to think about.</p>

<p>No, I&#8217;m not paranoid. I just like to experiment. </p>
<p>There&#8217;s only two reasons I&#8217;m doing so. First, to protect myself from you if you go after me (which wasn&#8217;t what prompted this in the first place, btw). Second, to give me a legal basis for pursuing spammers (why I went a-huntin&#8217; for TOS). Otherwise, you can chill. Get into the extended entry for more hot legalese action.</p>
<p>For those  more paranoid, here are the parts regarding <a href="#privacy">your privacy</a>, <a href="#posting">what you cannot post</a>, and <a href="#copyright">who owns what you post</a>. Basically, you have no privacy, you can&#8217;t post anything illegal, and I have the right to publish what you post under my Creative Commons license. Everything else is boilerplate.<br />

Terms of Service</p>
<p>Welcome to Barely Legal Substance (the &#8220;Service&#8221;), the weblog of Noel Weichbrodt (the &#8220;Proprietor&#8221;). Your use of the Service is subject to these Terms of Service (&#8220;TOS&#8221;). The Proprietor reserves the right to update and change the TOS from time to time without notice or acceptance by you.</p>

<p>c. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights (&#8220;Rights&#8221;) of any party;</p>
<p>d. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, &#8220;junk mail,&#8221; &#8220;spam,&#8221; &#8220;chain letters,&#8221; &#8220;pyramid schemes,&#8221; or any other form of solicitation; harm minors in any way;</p>
<p>e. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;</p>
<p>f. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;</p>
<p>g. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;</p>
<p>h. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;</p>
<p>i. collect or store personal data about other users.</p>
<p>You acknowledge that the Proprietor may or may not pre-screen Content, but that the Proprietor and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. Without limiting the foregoing, the Proprietor and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by the Proprietor or submitted to the Service, including without limitation information in comments, and in all other parts of the Service.</p>

You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will the Proprietor be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.<br />

You agree to indemnify and hold the Proprietor, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys&#8217; fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.</p>
<p>8. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY UNDERSTAND AND AGREE THAT:</p>
<p>A. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN &#8220;AS IS&#8221; AND &#8220;AS AVAILABLE&#8221; BASIS. THE PROPRIETOR EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.</p>
<p>B. THE PROPRIETOR MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.</p>
<p>C. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE PROPRIETOR OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.</p>
<p>9. LIMITATION OF LIABILITY. YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE PROPRIETOR SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE PROPRIETOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.</p>
<p>10. EXCLUSIONS AND LIMITATIONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTION 9 MAY NOT APPLY TO YOU.</p>
<p>11. Modifications to Service. The Proprietor reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that the Proprietor shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.</p>
<p>12. Miscellaneous. This Agreement shall be governed by the laws of Tennessee except for its conflicts of laws principles. Any dispute or claim arising out of or in connection with this Agreement shall be adjudicated in Hamilton County, Tennessee. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof. Any modifications to this Agreement must be made in a writing executed by both parties. The failure to require performance of any provision shall not affect a party&#8217;s right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself. If any provision herein is held unenforceable, then such provision will be modified to reflect the parties&#8217; intention, and the remaining provisions of this Agreement will remain in full force and effect. You may not resell, assign, or transfer any of Your rights hereunder. Any such attempt may result in termination of this Agreement, without liability to the Proprietor Notwithstanding the foregoing, the Proprietor may assign this Agreement at any time without notice. The section titles in the TOS are for convenience only and have no legal or contractual effect.</p>
